Terms and Conditions of Listing for Child Carers

 1. General Terms

  • Sitters4U shall keep all details of the Candidates strictly confidential.
  • Sitters4U is under no obligation to register or list a Candidate.
  • Sitters4U reserves the right to remove a Candidate from listing at any point in time.
  • Sitters4U does not guarantee placement.
  • Sitters4U has no direct employment relationship with the Candidate.

2. General Obligations of Candidates

  • The Candidate shall uphold the reputation, Mission and Vision of the Sitters4U at all times.
  • The Candidate shall provide accurate and complete information, to the best of the Candidates knowledge, in any and all application forms.
  • The Candidate accepts that any information provided by the applicant may be investigated by the agency and by any possible Clients.
  • The Candidate shall, under no circumstances, be under the influence of drugs or alcohol while working for any client of Sitters4U.
  • The Candidate shall declare all income to the appropriate Authorities and is responsible for payment of any and all taxes due by the Candidate to such authorities, which will be paid either directly to the Candidate by the Clients the Candidate is placed with for employment by Sitters4U or any amounts paid by a Client to Sitters4U to be paid to the Candidate for any period of employment with a Client.

3. Confidentiality

  • The Candidate undertakes to treat all information supplied by Sitters4U about or by a Client as strictly confidential and not to pass such information on to any third party, unless strictly required in order for the Candidate to carry out the Candidates obligations to the Client.
  • The Candidate understands that should a Client that they have met through Sitters4U or who has been referred to them through other Clients they have dealt with through Sitters4U contacts the Candidate, the Candidate must always first contact Sitters4U before speaking to the Client and must tell the Client to contact Sitters4U directly in order to request their services or to report the booking themselves to Sitters4U.
  • Should a Candidate introduced to the Client by Sitters4U enter into any other employment arrangement through the Client, directly or indirectly, such an arrangement must be reported by the Candidate to Sitters4U. Failure to do so will lead to immediate dismissal from listing and may lead to legal action due to loss of income from the Client.

4. Information, damages and indemnity:

  • In selecting Candidates , Sitters4U has relied on the information supplied by the Candidate and the information obtained from references supplied by the Candidates.
  • Sitters4U has relied on such information in good faith and has passed on such information to the Client in good faith.
  • Sitters4U shall bear no liability whatsoever for any loss or damage suffered by the Candidates, directly or indirectly, arising from the Candidates employment with the client.
  • In the event that the Candidate suffers any loss, injury or damage arising out of her employment with the client, the candidate hereby indemnifies Sitters4U in respect of any claims made against Sitters4U as a result of such loss, injury or damage by the Candidate or by any other person.

5. First Aid Course

  • All Candidates responsible for the care of a child should hold a current valid First Aid course certificate.
  • In order to be accepted for listing the Candidate must produce a valid current first aid certificate or sign up to complete a course through a registered course provider.

6. Disclaimer:

• The Agency does not accept any responsibility and/or liability in terms of any information or misrepresentation concerning the Client, nor shall it be liable for any loss or damage incurred or suffered by the Candidate, resulting from any act or omission of a Client or Candidate, whether accidental, intentional or through negligence.

7. Baby sitter Listing Terms

7.1. Availability for Babysitting

  • You will be listed as available for the times you selected, as those that you will be available to work.
  • It is the Candidates choice to apply for positions the candidate is notified of by sms, email or www.sitters4u.co.za.
  • Your listing will be terminated if you fail to be available for a position or job in the areas you have specified and responded to through the sms or other notification system on more than 3 occasions.
  • Your listing will be terminated if you fail to be available for a position or job in the areas you have specified, at the times you have specified on more than 3 occasions when given 48 hours notification of the available job on each of these 3 occasions.
  • The first time that this occurs there is a chance that you will receive less work until we are satisfied with the improvement.
  • On the second occasion your profile will be removed from babysitting availability although you may still be listed for other applied for positions.
  • If this level of unprofessional behaviour continues thereafter, we will remove you from our listing all together and you will not be welcome to re-apply.
  • Sitters4U reserves the right to remove your profile from our listing at any time.

7.2. Rates for Babysitting

  • Our babysitting clients are divided into 2 groups. They are either registered as members or as once off babysitting clients and pay different rates according to their needs and their client status. You will be informed of this rate in the notifications sent out and it is up to you as to whether you are happy with this rate.
  • If you respond to a notification for a position you accept the rate provided as the rate of pay.
  • Rates range from R 70 per hour upwards.

7.3. Notification

  • You will be notified of new babysitting positions via sms.
  • If you are not interested in a position, please do not reply.
  • You will receive information with regards to general area of the position, the age of the children, time, rate and date of the position, as well as a key word which is relevant to only that job.
  • Please reply with only this keyword to the number from which you received the notification.
  • On receipt of your reply, your profile will be forwarded with any other relevant applicants to the client as available to assist for the specified time/s.
  • Should you respond to a position you agree to make yourself available for the position up until 2 hours before a position starts. If you do not receive a response the position has most likely been filled by another candidate as chosen by the client.

7.4 Babysitting jobs

  • Should you receive a call from a client you have met through Sitters4U and the client contacts you directly telephonically or other wise, you must immediately contact Sitters4U to ensure Sitters4U has a record of the position, which will be added to your portfolio.

7.5. Payment

  • As you are an independent contractor you will be paid by the client in cash on the day of your booking unless otherwise specified by Sitters4U. Any such payment will be specified to you before putting you forward for a position.
  • Should you complete a hotel booking, you will be required to provide Sitters4U with your banking details as the hotel will make payment to Sitters4U. Once this payment is received from the Hotel that requested your services, Sitters4U will make payment to you on the closest Friday following the receipt of payment.

8. Au pair Listing Terms

8.1. Availability for Au pairing

  • You have been advertised as available for the times you selected on your application form as those that you will be available to work.
  • It is the Candidates choice to apply for positions the candidate is notified of by sms, email or www.sitters4u.co.za.
  • If the Candidate responds to a notification for a position, the Candidate expresses interest in the Position via this reply. The Candidates reply is an agreement to an interview with the client, and the Candidate must attend the interview. Not doing so is grounds for removal from listing. Please note that by responding to a position notification (sms, email, via the website or telephonically) you are requesting an interview.

8.2. Rates for Au pairing

Rates for Au pair positions are negotiable. We try to always get the best rates possible for both au pair and client.

8.2.1.Guidelines for rates:

The following rates are recommended but negotiable for temporary long term, half day and full time placement:
  • R 70 to R 200 per hour dependent on the requirements, your qualifications, age and experience.
  • If the Candidate uses the Candidates own vehicle for the client, please note, that petrol is paid for at a rate of R 3.50 p/km over and above the rates paid to the candidate for services rendered.
  • A Toddler is defined as a child who is under the age of 3 or over this age, but still using diapers.

8.3. Notification

  • You will be notified of new au pair positions via sms.
  • If you are not interested in a position, please do not reply.
  • You will receive information with regards to general area of the position, the age of the children, time, rate and date of the position, as well as a key word which is relevant to only that job.
  • Please reply with only this keyword to the number from which you received the notification if you are interested and available for the position.
  • Please do not respond to a position if you are unsure of your availability or interest in the position. Please rather call 0878085357 to determine that you would like to respond or not.
  • You will then receive a phone call for review of the position. If you are happy with the review and fit the requirements of the position we will then either set up an interview for you immediately or we will forward your profile to the client for review. This process varies from client to client.

8.4. Interviews

  • If you accept an interview with a family it is your responsibility to check that you have received all the information you are required to know about the family and the position you are being interviewed for in order to be present and on time for the interview you have been booked for. This information will be sent to the email address you have provided.
  • If you do not receive this information immediately email: sitters@sitters4u.co.za or call 0878085357 and please check your junk mail as well.
  • Please read through our interview guidelines by clicking here so that you can be thoroughly prepared for your interviews with clients.
  • Always review a clients full job specifications before attending an interview.

8.5. Positions

8.5.1.1 Long Term Positions (3 months or longer)

  • Should you receive a call from a client you have met through Sitters4U and the client contacts you directly telephonically or other wise, you must immediately contact Sitters4U to relay your reponse to the client so that Sitters4U can confirm the placement and forward the contract of employment to the client.
  • You should receive a contract of employment sent by Sitters4U to the client for you both to sign on your first day of work.
  • If you do not receive this document on your first day please email sitters@sitters4u.co.za or immediately call 0878085357.
  • Without a contract of employment you are not protected.

8.5.1.2. Payment for Long Term Positions

  • Should you receive a call from a client you have met through Sitters4U and the client contacts you directly telephonically or other wise, you must immediately contact Sitters4U to relay your reponse to the client so we Sitters4U can confirm the placement and forward the contract of employment to the client.
  • For Long term positions (Longer than 3 months) you will receive a contract of employment from the client which will specify your hours, duties, rate of pay and all other terms of employment.
  • You will be paid by your client directly on the dates as specified in your contract.
  • Your client will be responsible for the deductions of tax, UIF and any other taxes required to be paid by law.

8.5.2.1. Short Term Positions (Shorter than 3 months)

  • Should you receive a call from a client you have met through Sitters4U and the client contacts you directly telephonically or other wise, you must immediately contact Sitters4U to relay your reponse to the client so we Sitters4U can confirm the placement and forward the terms of employment and invoice for deposit to the client as well as your timesheet.
  • You will be contracting with the client as an independent contractor and will therefore be responsible for all tax and/or other payments required by law .
  • In the case of short term employment you will receive the job specifications as provided by the client and terms of short term employment by Sitters4U and a time sheet with which to track your hours as well as kilometres driven with the children in your vehicle.
  • It is your responsibility to ensure Sitters4U receives a copy of this time sheet on a weekly basis or on completion of the position, whichever comes first in order to bill your client.

8.5.2.2. Payment for Short Term Positions (Shorter than 3 months)

  • For positions where you are required to work for less than 1 month, payment will be processed to your provided account details on the Friday following the week in which the position was concluded
or,
  • In the case of short term positions which continue for longer than 1 calendar month payment will be processed on the last working Friday following your first completed month of service.

9. Release and Indemnity Agreement :

  • This document contains the whole agreement between the parties.
  • No variation, amendment, deletion or addition to these terms and conditions shall be valid unless in writing and signed by the parties.
  • Neither party shall be bound by any express or implied term, representation, warrant, promise or the like not recorded in this contract.
  • No indulgence granted by Sitters4U to the sitter/ au pair shall be deemed to be a waiver of any of rights of Sitters4U.

10. In order to list with Sitters4U you declare that:

  • You declare that you have read and have accepted all of the terms and conditions.
