1.Engagement of Services

1.1 You hereby request services from Sitters4U to procure LocalCARE on the terms set out below.
1.2 Using this website and its associated services constitutes your acceptance of these LocalCARE Terms and Conditions of Service and creates a binding legal agreement.
1.3 All legal issues arising from or related to the use of this site or Sitters4U's services shall be construed in accordance with the laws of South Africa.
1.4 Exclusive jurisdiction for any claim or dispute against Sitters4U resides in the courts of South Africa.
1.5 These LocalCARE Terms and Conditions of Service constitute the entire agreement between you and Sitters4U with respect to the use of this website, LocalCARE as described herein and all associated services.
In this document ;
  • “LocalCARE” shall mean any service contracted and delivered under Sitters4U’s LocalCARE service range as laid out herein.
  • “The Agency” shall mean Sitters4U.
  • The “Client” shall mean you, the party making use of The Agencies services to market  and source a child, student, home or other administrative care giver role in a private capacity on a long term basis or short term or long term adhoc basis, either online or in-person.
  • “Service Provider” shall mean both Vetted Service Providers and Unvetted Service Providers.
  • The "Vetted Service Provider" shall mean, any party referred to the Client, who has applied for the Clients advertised role as requested by the Client who has been document checked at the time of original application with the Agency, has been thoroughly interviewed and personally telephonically reference checked by the Agency.
  • "Unvetted Service Provider" shall mean, any party referred to the Client, who has applied for the Clients advertised role as requested by the Client who has not been fully screened and vetted referred through the Agencies network or marketing efforts but completes an initial micro vetting to insure the candidates meet the Client's requirements. Clients can then make the decision to either contact and vett these staff themselves, or to sponsor their application, request an identity background check and complete the rest of the vetting yourself, or to request full vetting by Sitters4U. Please note these candidates may not necessarily meet the Agency criteria for the Agencies requirements for professional staff.

2. Service

2.1 The Client declares that the Client is not an agency and is using this service in a personal capacity only.
2.2 The Client is solely responsible for the Clients own interactions with Service Providers.
2.3 The Client shall be responsible for the provision and accuracy of any information necessary for the Agency to perform the selected Services.  
2.4 The Client is under no obligation to employ any Service Provider referred to them through the Agency.
2.5 The Client shall keep all Service Providers’ details strictly confidential.
2.6 The Agency shall keep the Clients details strictly confidential except where details are required to be passed to Service Providers for the purpose of interviews or other legal reason.
2.7 In accordance with the Labour Relations Act and  the Basic Conditions of Employment Act, 1997, the Client must sign a Contract of Employment with a Service Provider on confirmation of  an employment offer being made to a Vetted or Unvetted Service 2.8 Provider referred through The Agency.
2.9 In the case of long term placements (any position extending beyond 3 months), the Client understands their legal obligation and must register the Service Provider with the relevant authorities for the purpose of payments of UIF and Tax or other payments.
2.10 The Agency's failure to enforce any right or provision in these LocalCARE Terms and Conditions of Service shall not constitute a waiver of such right or provision or of any other rights or provisions in these LocalCARE Terms and Conditions of Service.
2.11 If a court should find that one or more rights or provisions set forth in these LocalCARE Terms and Conditions of Service are invalid, the Client agrees that the remainder of the LocalCARE Terms and Conditions of Service shall be enforceable and that the invalid provision shall be enforceable to the fullest extent permitted by law.
2.12 The Agency reserves the right to vary these Terms & Conditions at any time in order to comply with legislative requirements or changes in the Agencies pricing or policies. Please visit www.sitters4u.co.za to ascertain our latest LocalCARE Terms & Conditions.
2.13 The Agency reserves the right to make changes to the Service as deemed necessary or desirable and may, in its sole discretion, change this agreement or any part thereof at any time without notice.

3. LocalCARE – Service Options

Under our LocalCARE we offer the following services:

3.1 Marketing Fee: R 850

3.1.1 On receipt of proof of payment, we will review your submitted job description and create a curated job description for your approval. Once approved, your job will be marketed and promoted for 3 months as follows;
  • Sent to our entire team in your city via WhatsApp Broadcasting
  • Sent to our entire team, nationally, bi weekly via our team newsletter , until registration expires or the role is placed, whichever occurs first
  • Post your job description to our websites job board /news section
  • Post your job description to our blog
  • Posted to our Instagram page and reposted weekly to our stories
  • Marketed across a number of external job sites
3.1.2 A marketing fee of R 850.00 (ZAR) must be paid in order to market the role the Client would like to place.
3.1.3 This fee is due on confirmation that you either verbally, in writing or otherwise, would like to go ahead in initialising a search with our Service Providers to gauge their interest in the position you are offering. This task will be performed with the intention of receiving applications for the position offered; by Service Providers, most closely matching the Clients requirements.
3.1.4 No service will take place until proof of payment of the registration fee has been received. In lieu of such payment, if the Client decides to cancel after providing permission to register the position either verbally, in writing or otherwise, payment of the marketing fee will be due immediately or in cases where it has .
3.1.5 Should changes to the job description, hours, requirements or salary offered be submitted after marketing has taken place, the position will need to be re-evaluated and re-registered in which case a new invoice to re-register the role will be issued.
3.1.6 The registration fee registers the Client for a maximum period of 90 days or per position offered or per Service Provider, to be advertised.
3.1.7 The marketing fee is non-refundable.
3.1.8 The marketing fee is valid for the advertising of the original approved enquiry only. Should changes be submitted after registration has taken place, the position will need to be re-evaluated and re-advertised.
3.1.9 Should the Marketing period expire, the client may remarket the role.

3.2 Receive Applications | Purchase Contacts

3.2.1 Marketing efforts will attract applications from pre vetted Service Providers through our already established base of Service Providers. Unvetted Service Providers will be sourced through referrals and external marketing efforts.

3.2.2 As Service Providers apply, all applicants will answer the following series of questions so that you only receive qualified applications for review, saving you time in having to establish this information and sift through applications:

  • Age                     
  • Area of Residence
  • Gender        
  • Nationality                
  • Marital Status            
  • Languages
  • Religion
  • BBBEE Status            
  • Dependents     
  • Drivers License (if applicable)        
  • Vehicle (if applicable)        
  • Experience Overview (Highlighting relevant Experience)             
  • Qualifications    
  • First Aid Status (if applicable)    
  • Available From
  • Smoking Status
  • Allergies
  • Vaccination Status
  • Live In | Out (if applicable)

Based on the provided information the Clients can then purchase:

  • Purchase Service Providers Direct Contact Details
    • Purchase Unvetted Profiles
    • Vetted Profiles
  • Vetting Services
    • Request an Identity Check 
3.3.2 Purchase Full Vetting Service
    • Purchase a Personalised Contract of Employment

3.3 Purchase Service Providers Direct Contact Details

Given the application information provided as described above, Clients can make a decision as to whether they would like to purchase any of the applying Service Providers direct contact information. Please note the following:

3.3.1 Unvetted Service Providers: R 500 per Contact
An Unvetted or micro vetted candidate is one that has applied for a role through Sitters4U who has completed our micro vetting application form which prior to full vetting deems them suitable for the role.

3.3.2 Listed (Pre-Vetted) Service Providers: R 1800 per Contact
Listed (Pre-Vetted) Service Providers are those that have been document checked, interviewed, and reference checked by The Agency at the time of their original application (some have been with us for as long as 15 years), to meet your criteria, prior to your contacting us.

Our listed and vetted Service Providers have already been through a criminal clearance check, ID check, driver’s license check, ITC check, completed a thorough application process related to the types of roles they are applying for, which if you are receiving their profile includes your needs, been through a thorough interviewing process, normally taking 1 to 2 hours per Service Provider and who have then been thoroughly reference checked at the time of approval and listing with the Agency.

3.4 Vetting Services

Under out vetting Services range, clients may purchase an “Identity Check” or a “Full Vetting Check”
The Agency is not responsible for losses or damages suffered by either the Service Provider or the Client in using this service.
The Client agrees that no service will be rendered without proof of payment.
Once Vetting Services as described in Section 3 of this document has been placed, and payment is received,  such orders are non-refundable.

3.4.1 Identity Checks: R 1000 per Contact

3.4.1.1 An  Identity Check may be purchased at R 1000 per check.
3.4.1.2 An Identity Check may be requested in order to establish the most recent information for pre vetted Service Providers, who were vetted more than 12 months ago.
3.4.1.3 An Identity Check may be purchased for the checking of an unvetted Service Provider.
3.4.1.4 An Identity Check may be purchased for the checking of a Service Provider sourced by the client independently.
3.4.1.5 Criminal Record Checks are not the full Criminal Clearance Certificates but provide a comprehensive report of what would be displayed on a Criminal Clearance Ceritficate swiftly in 2-3 days instead of 8 to 12 weeks for a full report.
3.4.1.6 The Client agrees not to hold the Agency liable in cases of delays of provision of the Identity Check.
3.4.1.7 The fee charged for an Identity Check is due and payable prior to service taking place.
3.4.1.8 The Agency is not responsible for losses or damages suffered by either the Service Provider or the Client in using this service.
3.4.1.9 The Client agrees not to hold the Agency liable in cases of delays of provision of the Identity Check.
3.4.1.10 The fee charged for an Identity Check is due and payable prior to service taking place.
3.4.1.11 The Client agrees that no service will be rendered without proof of payment.
3.4.1.12 Once the order for an Identity Check takes place and payment is received,  such orders are non-refundable.
3.4.1.13 Checks are run by our Screening Partner, if the person has previously has criminal clearances done, their details will be available on the criminal database else the person will need to come in to our partner to have finger printing done. An  Identity 3.4.1.14 Check has a 2 - 3 working day turnaround from the date of a Service Provider attending one of our screening partners offices and submitting finger prints or if they have previously been checked 2 - 3 working days from date of request receipt of payment), including;
  • Criminal Clearance Check
  • ID Check
  • Drivers License Check (where applicable)
  • ITC check

3.3.2 Purchase Full Vetting Services: R 2500 per Contact
Clients may request professional full vetting of unvetted, external or independently sourced Service Providers. Full vetting of Service Providers includes: 



1. An “Identity Check” as described above including;
Criminal Clearance Check
ID Check
Driver’s License Check (if applicable)
ITC check

2. A Professional Interview including;

Personal history review - relevant to position to be filled
Personality testing
Experience review
Gap checking (gaps in experience may indicate ‘hidden’ experiences)
Educational review

3. Personal Reference Checks:
We personally call references following a professional line of questions which highlights suitability of a particular Service Provider.

3.4 Purchase a Personalised Contract: R 1200

3.4.1 Before employing a Service Provider to work for them, Clients are required by law to have a contract of employment in place and signed before service is initiated.

3.4.2 The Agency provides the purchasing of a personalised contract of employment which is specific to the Clients needs, legal and complies with the BCEA and EEA, learn more about these 2 important documents here, including specialised disciplinary structures specifically designed and catering to the unique employment relationship for home based employers and employees and includes sections on all of the following:

3.4.3 Once ordered and paid for; fees paid for a personalised contract of employment are not refundable. 

The Agency will only provide contracts which fall within the scope of the employment laws of South Africa and will advise clients where the terms agreed with the contracted Service Provider may need to be adjusted to fall within legal bounds.

4. Prohibition Of Agencies and Competitors

4.1 Agencies and other competitors of the Agency placing roles as described under our FamilyCARE section on our website are prohibited from registering with Sitters4U.
4.2 Any individual or other entity in violation of this prohibition will be obligated to pay a contractual penalty of R 20,000.00 (Twenty Thousand) for each individual case.
4.3 This contractual penalty is to be paid independently of the actual damage. Apart from the contractual penalty, Sitters4U reserves the right to sue for compensation.

5. Suitability of Service Providers

The Agency shall use its best endeavors to ensure that the Service Provider s presented to the Client are suitable for the Client's needs, but expressly gives no warranty whatsoever that the Service Provider will be suitable.

6. Refund And Cancellation Policy

6.1 Due to the digital nature of the Agency’s LocalCARE as described herein, cancellation of paid and ordered services are not refundable.
6.2 The Client understands and agrees that the registration fee is never refundable.

7. Confidentiality

7.1 The Client hereby undertakes to treat all information supplied by The Agency about a Service Provider as confidential and not to pass such information on to any third party, unless required to do so in order for the Service Provider to carry out his or her duties to the Client.

8. Information, Damages, Indemnity and Liability

8.1 The Agency disclaims any and all liability for any loss, damage, costs or expenses suffered by the Client, directly or indirectly, arising from the Service Providers’ employment with the Client.
8.2 You, the Client agrees that The Agency does not endorse the content of any Service Provider or Client and is not responsible or liable for any such content, even though it may be unlawful, harassing, libellous, privacy invading, abusive, threatening, discriminatory, harmful, vulgar, obscene, or otherwise objectionable, or that infringes or may infringe the intellectual property or other rights of another.
8.3 The Agency does not have any obligation to monitor or control any Clients profile for any purpose. All content provided by a Client of the Agency website is the sole responsibility of that user.
8.4 The Agency disclaims any and all liability for any loss, damage, costs or expenses suffered by the Client, directly or indirectly, arising from the Service Providers’ employment with the Client.
8.5 The Agency is not responsible for losses or damages suffered by either the Service Provider or the Client.
8.6 In selecting Service Providers for listing, The Agency has relied on the information supplied by the Service Provider, and the information obtained from references supplied by the Service Provider.
8.7 The Agency has relied on such information in good faith and has passed on such information to the Client in good faith. The  Agency shall bear no liability whatsoever for any loss or damage suffered by the Client, directly or indirectly, arising from the Service Provider’s employment with the Client.
8.8 In the event that the Service Provider suffers any loss, injury or damage arising out of her employment with the Client, the Client hereby indemnifies The Agency in respect of any claims made against The Agency as a result of such loss, injury or damage by the Service Provider or by any other person.
8.9 Under FamilySERVICES the Agency is not responsible for selection of the Service Provider, payment of a Service Provider whom the Client makes an employment offer too, providing insurance or any payroll taxes and has no employment relationship with the Service Providers provided.
8.10 Should the Client use this service, the Client agrees that, should a Service Provider introduced to the Client by the Agency, enter into any contract of employment with or through the Client, whatsoever, directly or indirectly, notwithstanding that such employment would exclude the Agency from receiving it’s fees, the Agency shall be entitled to collect a fine based fee from the Client of R20 000(Twenty Thousand) (ZAR) for each individual violation and any legal costs incurred by the Agency when collecting this fine.

9. General

9.1 This document embodies the whole agreement between the Client and the Agency.
9.2 No variation, amendment, modification, deletion or addition to these terms and conditions shall be valid unless in writing, agreed to and signed by both the Client and the Agency.
9.3 Neither party shall be bound by any express or implied term, representation, warrant, promise or the like not recorded in this contract.
9.4 No indulgence granted by the Agency to the Client shall be deemed to be a waiver of any of rights of the Agency.
9.5 The Client understands that by agreeing to these terms and conditions the Client may not employ any friends or relatives of the Service Providers sent to them by the Agency.
